Terms of Service
These Terms govern your use of Focus Flow, a deep-work timer and analytics product operated by Kwami. By creating an account or using the service you agree to these Terms.
1. Who you are contracting with
Focus Flow ("the Service", "we", "us", "our") is operated by Kwami. When you use the Service you are entering into a legally binding agreement with Kwami. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to both you and the organization.
2. The Service
Focus Flow provides a focus-timer application with session tracking, a personal log of completed sessions ("Ledger"), aggregated analytics, and — for paying subscribers — cloud sync, extended history, and advanced analytics surfaces (the "Command" dashboard). Features may change, expand, or be removed over time as the Service evolves.
3. Accounts
Some parts of the Service (including cloud sync, Focus Flow Premium, and the Command dashboard) require an account. You must provide accurate information, keep your credentials confidential, and are responsible for all activity under your account. Notify us at support@digikwic.com if you believe your account has been compromised.
You must be at least 13 years old to use the Service (or the minimum age of digital consent in your jurisdiction, whichever is higher).
4. Acceptable use
You agree not to:
- use the Service for any unlawful, fraudulent, or deceptive purpose;
- infringe the intellectual property or privacy rights of others;
- interfere with or attempt to compromise the security or integrity of the Service (including probing, scanning, scraping at scale, deploying malware, or bypassing rate limits or authentication);
- resell, sublicense, or redistribute the Service or its content without our written permission;
- reverse engineer, decompile, or attempt to derive source code except to the extent expressly permitted by law.
5. Your content
You retain ownership of the content you enter into the Service — including goal names, session contracts, notes, and Ledger entries. You grant Kwami a limited, worldwide, royalty-free license to host, store, transmit, back up, and display that content solely as needed to operate and improve the Service for you.
6. Subscriptions, billing, and payments
Focus Flow Premium is offered as a monthly or annual subscription. Prices are shown at checkout in your local currency where available.
Our order process is conducted by our online reseller Paddle.com Market Limited. Paddle.com Market Limited is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax collection, invoicing, subscription management, cancellations, and refund processing are governed by the Paddle Checkout Buyer Terms.
Subscriptions renew automatically at the end of each billing period at the then-current price until you cancel. You can cancel at any time from the Paddle customer portal at paddle.net (also reachable from the "Manage Subscription" button in the Command dashboard).
- Cancellation: takes effect at the end of the current billing period. Premium access remains available until that date.
- Upgrades / downgrades: switch takes effect immediately with a pro-rated charge or credit calculated by Paddle.
- Failed payment: Premium access is preserved during Paddle's standard retry window. If retries fail the subscription is canceled.

8. Intellectual property
Focus Flow, including its software, design, branding, documentation, and content authored by us, is owned by Kwami and protected by copyright and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service in accordance with these Terms and the plan you have subscribed to.
9. Service availability
We work to keep the Service available and performant, but we do not guarantee uninterrupted, timely, secure, or error-free operation. We may modify, suspend, or discontinue features at any time, and we may perform maintenance that temporarily limits availability.
10. Suspension and termination
We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay amounts due, present a security or fraud risk, or repeatedly violate our policies. You may stop using the Service at any time; deleting your account cancels any active subscription at the end of the current billing period.
11. Warranty disclaimer
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of liability
To the fullest extent permitted by law, Kwami and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our aggregate liability for any claim arising out of or related to these Terms or the Service will not exceed the greater of the amounts you paid us in the twelve (12) months preceding the event giving rise to the claim, or fifty US dollars (US$50). Nothing in these Terms excludes liability that cannot be excluded under applicable law.
13. Indemnification
You agree to defend, indemnify, and hold harmless Kwami from and against any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of or related to your content, your use of the Service, or your violation of these Terms or applicable law.
14. Changes to these Terms
We may update these Terms from time to time. If we make material changes we will provide reasonable notice (for example, by email to your account address or by an in-product notice) before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
15. Governing law
These Terms are governed by the laws of the United States, without regard to conflict-of-law principles. Any dispute arising out of or related to these Terms will be resolved in the courts located in that jurisdiction, except where mandatory local law requires otherwise.
